USCIS Proposes Enhancements to Streamline EB-5 Investor Visa Program

U.S. Citizenship and Immigration Services (USCIS) is proposing significant changes to the USCIS Immigrant Investor Program (the EB-5 Visa Program).  The EB-5 Program makes 10,000 visas available annually to immigrant investors who invest in commercial enterprises that create at least 10 U.S. jobs.  The program was created to create incentives for non-US investors and entrepreneurs to create jobs in America.

USCIS is proposing three changes to the way the EB-5 applications work.   The first proposed change is to accelerate processing of applications for job-creating projects that are fully developed and ready to be implemented. Such petitioners will also now have the option to request the fee-based Premium Processing Service, with a guaranteed processing within 15 calendar days.

The second proposed change is the creation of new specialized intake teams with expertise in economic analysis and the EB-5 Program requirements with whom the applicants will be able to communicate directly via e-mail to facilitate and streamline the resolution of issues and quickly address questions or needs related to their applications.

The third proposal is to convene an expert Decision Board to render decisions regarding EB-5 applications. This Decision Board will include an economist and adjudicators and will be supported by legal counsel.
