			<content:encoded><![CDATA[<p style="text-align:justify;">The U.S. Consulate General in Chennai will no longer process Immigrant Visa petitions as of January 1, 2012. The U.S. Embassy in New Delhi and U.S. Consulate in Mumbai will become the only acceptance centers in India for Immigrant Visas. Immigrant visas are for persons who plan to live permanently in the United States.</p>
<p style="text-align:justify;">Please note that this change does not affect temporary, nonimmigrant visa categories such as B-1/B-2, F-1, and H-1/H-4, which continue to be processed at all U.S. consulates in India, including Chennai.</p>
<p style="text-align:justify;">The U.S. Consulate at Chennai will continue processing pending Immigrant visa cases, which were interviewed on or before December 30, 2011. They also will continue accepting requested documentation related to these pending cases.</p>

			<content:encoded><![CDATA[<p>This post provides an overview about the connection between immigration and taxes for a lawful permanent resident (LPRs).</p>
<p>LPRs, popularly known as green-card holders, are typically concerned about how their immigration status will affect their taxes. This concern is particularly important for those that have either newly acquired a green card, have moved abroad for short-term work or have retired to their native country.</p>
<p>There is a common misconception amongst many LPRs that you become tax residents only if you spend at least 183 days in the United States. To clarify, the 183 day rule is only applicable to non-immigrant visa holders.</p>
<p>As soon you acquire a green card, you are automatically classified as a US tax resident and all green-card holders, like US citizens, are required to report worldwide income by filing a federal income tax return each year (IRS Form 1040) by April 15th. So, whether you live or work outside the United States you continue to be treated as a resident for U.S. tax purposes and are obligated report your world-wide income to the IRS and this reporting requirement applies irrespective of whether the income was earned within the country or internationally.</p>
<p>Therefore, under the relevant regulations, you must file an annual tax return unless (a) the LPR status has been revoked or (b) if it has been administratively or judicially determined to have been abandoned or (c) the US residence status is affected by an international income tax treaty so that you are not subject to double taxation.</p>
<p>However, in practice these regulations may create seemingly inconsistent situations between U.S. Immigration law, U.S. tax law and income tax treaties. For instance, consider a situation where an LPR is absent from the US for a long time, and on their return a determination is made by the USCIS that the LPR has not maintained his/her green card status and thereby abandoned the U.S. as his/her permanent residence. Until that determination has actually been made, the income tax filing requirement and any tax obligations will continue for that LPR. The USCIS does not know an LPR’s status until s/he tries to return to the United States after a length of time. Therefore, although an LPR’s green card may be invalid upon entry into the United States and his/her status considered abandoned, the individual must continue to file tax returns until a final determination of revocation or abandonment has been made by the USCIS. A final determination of abandonment may not take place many years after the actual act of abandonment.</p>
<p>For sake of completeness, it should be mentioned that failure to file US taxes can not only hurt an individual’s chances of seeking US citizenship but may also be a criminal offense which could result in loss of green card and eventual deportation from the country.</p>
<p>This is a complicated area of law and if you are seeking further advice about your specific situation, it is recommended that you discuss your circumstances with an experienced attorney or CPA who can guide you about your best options.</p>

			<content:encoded><![CDATA[<p><strong>STATUTORY NUMBERS</strong></p>
<p>1. This bulletin summarizes the availability of immigrant numbers during <strong>February</strong>. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; U.S. Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status. Allocations were made, to the extent possible, in chronological order of reported priority dates, for demand received by January <strong>6th</strong>. If not all demand could be satisfied, the category or foreign state in which demand was excessive was deemed oversubscribed. The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date <strong>earlier than</strong> the cut-off date may be allotted a number. If it becomes necessary during the monthly allocation process to retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date announced in this bulletin.</p>
<p>2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320.</p>
<p>3. INA Section 203(e) provides that family-sponsored and employment-based preference visas be issued to eligible immigrants in the order in which a petition in behalf of each has been filed. Section 203(d) provides that spouses and children of preference immigrants are entitled to the same status, and the same order of consideration, if accompanying or following to join the principal. The visa prorating provisions of Section 202(e) apply to allocations for a foreign state or dependent area when visa demand exceeds the per-country limit. These provisions apply at present to the following oversubscribed chargeability areas: CHINA-mainland born, INDIA, MEXICO, and PHILIPPINES.</p>
<p>4. Section 203(a) of the INA prescribes preference classes for allotment of Family-sponsored immigrant visas as follows:</p>
<p><strong>FAMILY-SPONSORED PREFERENCES</strong></p>
<p><strong>First</strong><strong>:</strong> (<strong>F1</strong>) Unmarried Sons and Daughters of U.S. Citizens: 23,400 plus any numbers not required for fourth preference.</p>
<p><strong>Second:</strong> Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, plus any unused first preference numbers:</p>
<p>A. (<strong>F2A</strong>) Spouses and Children of Permanent Residents: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;</p>
<p>B. (<strong>F2B</strong>) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents: 23% of the overall second preference limitation.</p>
<p><strong>Third: (F3)</strong> Married Sons and Daughters of U.S. Citizens: 23,400, plus any numbers not required by first and second preferences.</p>
<p><strong>Fourth: (F4)</strong> Brothers and Sisters of Adult U.S. Citizens: 65,000, plus any numbers not required by first three preferences.</p>
<p>On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); &#8220;C&#8221; means current, i.e., numbers are available for all qualified applicants; and &#8220;U&#8221; means unavailable, i.e., no numbers are available. <p><strong>Fourth:</strong> Certain Special Immigrants: 7.1% of the worldwide level.</p>
<p><strong>Fifth:</strong> Employment Creation: 7.1% of the worldwide level, not less than 3,000 of which reserved for investors in a targeted rural or high-unemployment area, and 3,000 set aside for investors in regional centers by Sec. 610 of Pub. L. 102-395.</p>

<p>*Employment Third Preference Other Workers Category: Section 203(e) of the Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997, as amended by Section 1(e) of Pub. L. 105-139, provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year. This reduction is to be made for as long as necessary to offset adjustments under the NACARA program. Since the EW cut-off date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002.</p>
<p>6. The Department of State has a recorded message with visa availability information which can be heard at: (202) 663-1541. This recording is updated on or about the tenth of each month with information on cut-off dates for the following month.</p>
<p><strong>B. DIVERSITY IMMIGRANT (DV) CATEGORY</strong></p>
<p>Section 203(c) of the INA provides up to 55,000 immigrant visas each fiscal year to permit additional immigration opportunities for persons from countries with low admissions during the previous five years. The NACARA stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program. <strong>This resulted in reduction of the DV-2012 annual limit to 50,000</strong>. DV visas are divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year.</p>
<p>For <strong>February</strong>, immigrant numbers in the DV category are available to qualified DV-2012 applicants chargeable to all regions/eligible countries as follows. <p>Entitlement to immigrant status in the DV category lasts only through the end of the fiscal (visa) year for which the applicant is selected in the lottery. The year of entitlement for all applicants registered for the DV-2012 program ends as of September 30, 2012. DV visas may not be issued to DV-2012 applicants after that date. Similarly, spouses and children accompanying or following to join DV-2012 principals are only entitled to derivative DV status until September 30, 2012. 			<content:encoded><![CDATA[<p><strong>STATUTORY NUMBERS</strong></p>
<p>1. This bulletin summarizes the availability of immigrant numbers during <strong>January</strong>. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; U.S. Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status. Allocations were made, to the extent possible, in chronological order of reported priority dates, for demand received by December <strong>8th</strong>. If not all demand could be satisfied, the category or foreign state in which demand was excessive was deemed oversubscribed. The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date <strong>earlier than</strong> the cut-off date may be allotted a number. If it becomes necessary during the monthly allocation process to retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date announced in this bulletin.</p>
<p>2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320.</p>
<p>3. INA Section 203(e) provides that family-sponsored and employment-based preference visas be issued to eligible immigrants in the order in which a petition in behalf of each has been filed. Section 203(d) provides that spouses and children of preference immigrants are entitled to the same status, and the same order of consideration, if accompanying or following to join the principal. The visa prorating provisions of Section 202(e) apply to allocations for a foreign state or dependent area when visa demand exceeds the per-country limit. These provisions apply at present to the following oversubscribed chargeability areas: CHINA-mainland born, INDIA, MEXICO, and PHILIPPINES.</p>
<p>4. Section 203(a) of the INA prescribes preference classes for allotment of Family-sponsored immigrant visas as follows:</p>
<p><strong>FAMILY-SPONSORED PREFERENCES</strong></p>
<p><strong>First</strong><strong>:</strong> (<strong>F1</strong>) Unmarried Sons and Daughters of U.S. Citizens: 23,400 plus any numbers not required for fourth preference.</p>
<p><strong>Second:</strong> Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, plus any unused first preference numbers:</p>
<p>A. (<strong>F2A</strong>) Spouses and Children of Permanent Residents: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;</p>
<p>B. (<strong>F2B</strong>) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents: 23% of the overall second preference limitation.</p>
<p><strong>Third: (F3)</strong> Married Sons and Daughters of U.S. Citizens: 23,400, plus any numbers not required by first and second preferences.</p>
<p><strong>Fourth: (F4)</strong> Brothers and Sisters of Adult U.S. Citizens: 65,000, plus any numbers not required by first three preferences.</p>

<p><strong>Fifth:</strong> Employment Creation: 7.1% of the worldwide level, not less than 3,000 of which reserved for investors in a targeted rural or high-unemployment area, and 3,000 set aside for investors in regional centers by Sec. 610 of Pub. L. 102-395.</p>

<p><strong>D. CHINA-MAINLAND BORN AND INDIA EMPLOYMENT-BASED SECOND PREFERENCE VISA AVAILABILITY IN THE COMING MONTHS</strong></p>
<p>The China and India Employment Second preference cut-off date has been advanced at a rapid rate in recent months. As previously noted, this action was intended to generate significant levels of new filings for adjustment of status at U.S. Citizenship and Immigration Services (USCIS) offices. USCIS has reported that the rate of new filings is currently far below that which they had anticipated, prompting an even more aggressive movement of the cut-off date for January and possibly beyond. While this action greatly increases the potential for an eventual retrogression of the cut-off at some point during the year, it also provides the best opportunity to utilize all numbers available under the annual limit.</p>

			<content:encoded><![CDATA[<p><strong>STATUTORY NUMBERS</strong></p>
<p>1. This bulletin summarizes the availability of immigrant numbers during <strong>December</strong>. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; U.S. Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status. Allocations were made, to the extent possible, in chronological order of reported priority dates, for demand received by November <strong>8th.</strong> If not all demand could be satisfied, the category or foreign state in which demand was excessive was deemed oversubscribed. The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date <strong>earlier than</strong> the cut-off date may be allotted a number. If it becomes necessary during the monthly allocation process to retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date announced in this bulletin.</p>
<p>2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000.  The worldwide level for annual employment-based preference immigrants is at least 140,000.  Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620.  The dependent area limit is set at 2%, or 7,320.</p>
<p>3. INA Section 203(e) provides that family-sponsored and employment-based preference visas be issued to eligible immigrants in the order in which a petition in behalf of each has been filed.  Section 203(d) provides that spouses and children of preference immigrants are entitled to the same status, and the same order of consideration, if accompanying or following to join the principal.  The visa prorating provisions of Section 202(e) apply to allocations for a foreign state or dependent area when visa demand exceeds the per-country limit.  These provisions apply at present to the following oversubscribed chargeability areas:  CHINA-mainland born, INDIA, MEXICO, and PHILIPPINES.</p>
<p>4.  Section 203(a) of the INA prescribes preference classes for allotment of Family-sponsored immigrant visas as follows:<strong>         </strong></p>
<p><strong>FAMILY-SPONSORED PREFERENCES</strong></p>
<p><strong>First</strong>:  (<strong>F1</strong>) Unmarried Sons and Daughters of U.S. Citizens:  23,400 plus any numbers not required for fourth preference.<br />
<strong><br />
Second</strong>:  Spouses and Children, and Unmarried Sons and Daughters of Permanent<br />
Residents:  114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, plus any unused first preference numbers:</p>
<p>A. (<strong>F2A</strong>) Spouses and Children of Permanent Residents:  77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;</p>
<p>B. (<strong>F2B</strong>) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents:  23% of the overall second preference limitation.</p>
<p><strong>Third</strong>:  (<strong>F3</strong>) Married Sons and Daughters of U.S. Citizens:  23,400, plus any numbers not required by first and second preferences.</p>
<p><strong>Fourth</strong>:  (<strong>F4</strong>) Brothers and Sisters of Adult U.S. Citizens:  65,000, plus any numbers not required by first three preferences.</p>
<p>On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); &#8220;C&#8221; means current, i.e., numbers are available for all qualified applicants; and &#8220;U&#8221; means unavailable, i.e., no numbers are available.  (NOTE:  Numbers are available only for applicants whose priority date is <strong>earlier</strong> than the cut-off date listed below.)</p>

<p><strong>EMPLOYMENT-BASED PREFERENCES</strong></p>

<p><strong>Second:</strong> Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability:  28.6% of the worldwide employment-based preference level, plus any numbers not required by first preference.</p>
<p><strong>Third:</strong> Skilled Workers, Professionals, and Other Workers:  28.6% of the worldwide level, plus any numbers not required by first and second preferences, not more than 10,000 of which to &#8220;*Other Workers&#8221;.</p>
<p><strong>Fourth:</strong> Certain Special Immigrants:  7.1% of the worldwide level.</p>
<p><strong>Fifth:</strong> Employment Creation:  7.1% of the worldwide level, not less than 3,000 of which reserved for investors in a targeted rural or high-unemployment area, and 3,000 set aside for investors in regional centers by Sec. 610 of Pub. L. 102-395.</p>

<p>*Employment Third Preference Other Workers Category:  Section 203(e) of the Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997, as amended by Section 1(e) of Pub. L. 105-139, provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year.  This reduction is to be made for as long as necessary to offset adjustments under the NACARA program.  Since the EW cut-off date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002.</p>
<p>6.  The Department of State has a recorded message with visa availability information which can be heard at:  (202) 663-1541.  This recording is updated on or about the tenth of each month with information on cut-off dates for the following month.</p>
<p><strong>B. DIVERSITY IMMIGRANT (DV) CATEGORY</strong></p>
<p>Section 203(c) of the INA provides up to 55,000 immigrant visas each fiscal year to permit additional immigration opportunities for persons from countries with low admissions during the previous five years.  The NACARA stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program.  <strong>This resulted in reduction of the DV-2012 annual limit to 50,000.</strong>  DV visas are divided among six geographic regions.  No one country can receive more than seven percent of the available diversity visas in any one year.</p>
<p>For <strong>December</strong>, immigrant numbers in the DV category are available to qualified DV-2012 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers <strong>BELOW</strong> the specified allocation cut-off number:</p>

<p>Entitlement to immigrant status in the DV category lasts only through the end of the fiscal (visa) year for which the applicant is selected in the lottery.  The year of entitlement for all applicants registered for the DV-2012 program ends as of September 30, 2012.  DV visas may not be issued to DV-2012 applicants after that date.  Similarly, spouses and children accompanying or following to join DV-2012 principals are only entitled to derivative DV status until September 30, 2012.  DV visa availability through the very end of FY-2012 cannot be taken for granted.  Numbers could be exhausted prior to September 30.</p>
<p><strong>C. ADVANCE NOTIFICATION OF THE DIVERSITY (DV) IMMIGRANT CATEGORY RANK CUT-OFFS WHICH WILL APPLY IN JANUARY</strong></p>
<p>For <strong>January</strong>, immigrant numbers in the DV category are available to qualified DV-2012 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers <strong>BELOW</strong> the specified allocation cut-off number:</p>

			<content:encoded><![CDATA[<p>The U.S. Mission to India recently reported that H-1B (specialized skills work visa) issuances in India increased 24% between the U.S. Government’s Fiscal Year (FY) 2011 and FY2010. This marks a total increase from 54,111 issued in 2010 to 67,195 in 2011. The U.S. Government’s fiscal year extends from October through September. FY2011 recently concluded on September 30, 2011.</p>
<p>This 24% increase is tied to the highest ever H-1B application and issuance rates in the history of the U.S. Mission to India, and illustrates the booming nature of U.S.-India business relations. India is the single largest beneficiary of H-1B visas by a wide margin: in the past four years, applicants in India have received more than twice as many H-1B visas as the four next-highest countries combined.</p>

			<content:encoded><![CDATA[<p>Blanket L Visa processing will move to the U.S. Consulate General in Chennai on December 1, 2011.  The U.S. Consulate General in Chennai will become the sole acceptance center in India for all applications for intracompany transfers under the blanket L category as of December 1, 2011.</p>
<p>The U.S. Embassy in New Delhi and U.S. Consulates in Mumbai, Kolkata and Hyderabad will no longer accept or process applications for this visa category. The blanket L category includes specialized knowledge professionals, executives and managers. All other visa processing procedures remain unchanged.</p>
<p>Please note that spouse and children visas (L2) and individual L visas (L1B and L1A individuals) may be processed at all posts in India—Chennai, Hyderabad, Kolkata, Mumbai, and New Delhi.</p>

<p><span style="direction:ltr;">The deadline for submitting an application under this program is no later than 12 noon EDT on Saturday November 5, 2011. Applications after this deadline will not be accepted for the 2013 DV lottery.</span></p>
<p>DV 2013 applications are electronic only&#8230;no paper entries will be accepted.  Applicants can access the electronic DV Entry Form and instructions at <a href="https://www.dvlottery.state.gov/" target="_blank">https://www.dvlottery.state.gov/</a>.</p>

<p><span style="direction:ltr;">USCIS has published a </span><a style="direction:ltr;" title="http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=93da6b814ba81310VgnVCM100000082ca60aRCRD&amp;vgnextchannel=6abe6d26d17df110VgnVCM1000004718190aRCRD" href="http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=93da6b814ba81310VgnVCM100000082ca60aRCRD&amp;vgnextchannel=6abe6d26d17df110VgnVCM1000004718190aRCRD">Frequently Asked Questions (FAQs)</a><span style="direction:ltr;"> document on its website clarifying that entrepreneurs may obtain an employment-based second preference (</span>EB-2<span style="direction:ltr;">) immigrant visa if they satisfy the existing requirements, and also may qualify for a National Interest Waiver under the EB-2 immigrant visa category if they can demonstrate that their business endeavors will be in the interest of the United States. USCIS will complement these FAQs with internal training on the unique characteristics of entrepreneurial enterprises and startup companies and incorporate input from the upcoming stakeholder engagements detailed below.</span></p>
<p>The EB-2 visa classification includes foreign workers with advanced degrees and individuals of exceptional ability in the arts, sciences, or business. Generally, an EB-2 visa petition requires a job offer and a Department of Labor certification. These requirements can be waived under existing law if the petitioner demonstrates that approval of the EB-2 visa petition would be in the national interest of the United States.</p>
<p><span style="direction:ltr;">An H-1B beneficiary who is the sole owner of the petitioning company may establish a valid employer-employee relationship for the purposes of qualifying for an H-1B nonimmigrant visa – which is used by U.S. businesses to employ foreign workers in specialty occupations that require theoretical or technical expertise in specialized fields, such as science, engineering, and computer programming.</span></p>
<p><span style="direction:ltr;">USCIS has also announced the expansion of its </span>Premium Processing Service<span style="direction:ltr;"> to immigrant petitions for multinational executives and managers (often referred to as &#8220;E13&#8243;). The Premium Processing Service allows employers to expedite processing of their petitions, absent evidentiary deficiencies, fraud or national security concerns.</span></p>
